1. Purpose of the online store

The GrowMedica online store is used mainly to present and sell products offered by the operator and to provide related information. The operator is GrowMedica s.r.o., Belová 6, 040 01 Košice, Slovakia, Company ID (IČO) 56 455 143, Tax ID (DIČ) 2122314975.

To the extent permitted by law, the operator may change the content, features, appearance, availability or individual parts of the online store.

The operator does not guarantee uninterrupted or error-free availability of the website. The website may be temporarily unavailable, in particular due to maintenance, updates, technical faults, outages of service providers or other circumstances that the operator cannot reasonably influence.

2. Information on the website

The operator makes reasonable efforts to ensure that the information published in the online store is correct, complete and up to date.

Some product information may come from manufacturers, distributors, suppliers or other third parties.

Photos and graphic representations of products may be illustrative. The appearance of the packaging, label or product may change, in particular when the manufacturer changes the packaging.

If the information on the website differs from the information on the current product packaging, the customer should, before using the product, pay attention primarily to the information, warnings, ingredients and instructions stated on the product itself.

This does not affect the seller’s statutory obligations regarding the accuracy of information provided to consumers.

3. Information relating to health and nutrition

The information published by GrowMedica is of a general informative nature.

The content of the online store is not individual medical advice and does not replace an examination, diagnosis, treatment or the recommendation of a doctor, pharmacist or other qualified healthcare professional.

Food supplements are not a substitute for a varied and balanced diet and a healthy lifestyle.

Products must be used in accordance with the information, warnings, recommended daily intake and instructions provided by the manufacturer.

The customer should not exceed the recommended daily intake.

People taking medication, people with health conditions, pregnant or breastfeeding women, children or people with special health needs should consult an appropriate healthcare professional about whether a particular product is suitable for them, where such consultation is appropriate given the nature of the product or their health.

The information on the website cannot be interpreted as a guarantee of any particular health, therapeutic or other result from using a product.

4. Individual experience

Experience with individual products may vary from person to person.

Many individual circumstances may influence the experience of using a product.

Unless the law provides otherwise, the operator does not guarantee any particular subjective, health-related or other result from using a product.

5. User responsibility

The user must use the website and purchased products properly and in accordance with the law, these terms and the relevant instructions.

Before using a product, the customer must read the information and warnings stated on its packaging.

To the extent permitted by law, the operator is not liable for consequences caused by using a product contrary to the instructions, ignoring the manufacturer’s warnings, incorrect storage or other improper handling by the user.

6. Limitation of liability

To the maximum extent permitted by applicable law, the operator is not liable for damage or other harm arising solely from:

  • incorrect or inappropriate use of a product by the customer,
  • use of a product contrary to the manufacturer’s instructions or warnings,
  • exceeding the recommended daily intake,
  • unauthorised interference by the user or a third party,
  • incorrect storage of a product after the customer has received it,
  • incorrect information provided by the customer,
  • technical problems or outages of third-party services that the operator could not reasonably influence,
  • force majeure or other circumstances beyond the operator’s reasonable control.

Where information comes from the manufacturer or supplier, the operator may rely on such data when creating product content. This does not exclude the seller’s obligations under applicable law.

Nothing in these Terms of Service excludes or limits the operator’s liability that cannot validly be excluded or limited under mandatory law, or the statutory rights of consumers.

7. Third-party websites and services

The online store may contain links to, or use services of, third parties, for example payment, delivery, analytics or technology providers.

The operator is not responsible for the content, availability or independent conduct of third parties to the extent that it has no control over them and such liability can be excluded under applicable law.

The use of third-party services may be subject to their own terms.

8. Technical availability

The operator does not guarantee that the online store will always be available without interruption or technical errors.

The operator may temporarily restrict the website, in particular for maintenance, security, updates or to fix a technical problem.

To the maximum extent permitted by law, the operator is not liable for damage caused by an outage or technical fault that it did not cause and could not reasonably prevent.

9. Prohibited use

The user must not use the online store in a way that is unlawful or that may harm the operator, another user or a third party.

In particular, unauthorised interference with the website, attempts to breach its security, spreading malicious code, automated collection of content in breach of the law, or unauthorised use of the content of the online store are prohibited.

To the extent permitted by law, the operator may restrict access for a user who breaches these rules.

10. Intellectual property

Texts, photos, graphics, logos, design and other content of the online store may be protected by intellectual property rights of the operator or of the relevant third parties.

Without an appropriate legal basis or the consent of the rights holder, this content may not be copied, reproduced, distributed, used commercially or otherwise used without authorisation.

11. Prices, availability and errors

The operator strives to state correct prices, availability and product information. Prices are stated in euros. The operator is not a VAT payer, so no VAT is charged; shipping costs are added in checkout.

In the event of an obvious technical, typographical or system error, the situation will be resolved in accordance with applicable law and consumer rights.

This provision cannot be interpreted as allowing the operator to unilaterally remove rights that the customer has already acquired under applicable law.

12. Changes to the service and these terms

The operator may change these Terms of Service, in particular due to changes in legislation, the operation of the online store, the technologies used or the services provided.

The current version will be published in the online store.

A change to these terms shall not retroactively remove rights the customer has already acquired, unless the law provides otherwise.

13. Consumer protection

These Terms of Service shall be interpreted so as not to limit consumer rights that cannot be excluded or limited by contract under applicable law.

If any provision of these terms conflicts with a mandatory legal provision, the legal provision shall prevail.

The invalidity or unenforceability of one provision does not affect the other provisions to the extent that they can remain effective on their own.

The terms of purchase (conclusion of the contract, delivery, withdrawal and complaints) are set out in the Terms and Conditions, the withdrawal information and the Complaints procedure.

14. Governing law

Legal relationships relating to the use of the online store are governed by the laws of the Slovak Republic.

If the customer is a consumer habitually resident in another member state of the European Union, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law that would apply without this choice.
